Legal Aid rates of pay for criminal barristers are appalling. Many are paid less than minimum wage. If they were employees, they would sue - and win. And HMRC would prosecute the Legal Aid Agency. But they’re not. So they can’t. So they have to strike. Good luck to them.

Getting cross at all the tweets saying employees have a ‘right’ to call in sick if they don’t want to work on a particular date. No they don’t. If they’re not genuinely sick, it’s called being AWOL. If they get paid sick pay, it’s fraud. And either way, it’s sackable.

BBC news just now: Israel hasn’t yet provided conclusive evidence that the hospital is being used by Hamas. Really? ‘Conclusive’? I’m not sure whether the correct test is ‘credible’ or ‘probable’ evidence, but it cannot be ‘conclusive’. No court has ever demanded that.

Two weeks ago, the BSB gave five of us barristers two days to produce a full proposal for a Bar-led solution on solving the BPTC exam fiasco. @phatsilk_qc @SCynic1 @MattJEJackson @LHoyano and I worked flat out to meet that deadline. The BSB has now sat on it for two weeks.

The EAT judgment was plainly correct. The real fight in this case should always have been about the reason for the non-renewal of the contract. The employer took a barely arguable point, won (to everyone’s surprise), it got overturned on appeal, and now it’s the important issue.

Here it is: CGD are not appealing the Employment Appeal Tribunal judgment that gender critical beliefs are worthy of respect in a democratic society. The judgment stands and is a legal precedent. Next step: employment tribunal to hear the rest of the case. I am very happy!

1/ I got 3 Bs. I did not get into my main or insurance university. I had to take a year out. I did not get a pupillage at a set of the calibre I wanted (it dissolved a long time ago). Life deals blows which seem insurmountable at the time, but life can work out good nevertheless.
