This could be decisive for Everton. Yes, the UK has left the EU, but the PL is bound up in UEFA and so proceeds as if governed by European Law. Having punitive sanctions decided in a vacuum offends against fairness under the common law in any event.

My reading of the ECJ ruling is it gives the @premierleague a big headache over their treatment of @everton . It says sanctions must be based on “transparent” criteria.👇🏻 The PL’s refusal to publish details of its “formula” is therefore a huge problem. So we fight on! 💪🏻 #EFC

So there you have it, after days of legal argument and thousands of words of reasoning, the Commission in the Forest case did not know how the Appeal Board in Everton’s case adopted such a high starting point in terms of points to be deducted.

Seems clear that Notts Forest looked at the Everton case and decided, strategically, to plead remorse and cooperation from the earliest stage. Having wilfully broken the rules to benefit their playing squad. Pretty cynical, but pretty effective as it turns out.

Reasonable to assume that EFC’s appeal will rely heavily on the Commission declining to adopt the EFL guideline on successive PSR breaches. The lack of any equivalent PL guidelines has again resulted in a Commission resorting to its ‘wide discretion’ - totally unsatisfactory.

A sensible suggestion. The lack of consistency across decisions, even after guidance from an Appeal Board, has exposed the current system as unfit. If the PL wants to have any chance of keeping its enforcement in-house it should do the right thing.

Following the points deduction imposed on Nottingham Forest, the Nottingham MPs have written to the Culture, Media and Sport Secretary. Sanctions must be fair and consistent. We call for all proceedings and sanctions to be suspended until an independent regulator is in force.

On double jeopardy, you can call it that, or simply call it proportionality, which features strongly in the Appeal Board’s decision. Either way you get to the same result: you can’t be punishing twice for overlapping reporting periods.

As to EFC, I’d be arguing that the objectively harsh punishment for charge 1 reinforces why it should be nothing more for charge 2. Best they can do.

Whether or not EFC voted against a framework of guidelines, or indeed whether other clubs did, does not change any of this. The uncertainty inherent in the rules is a recipe for disaster. ‘You reap what you sow’ is not a legal principle.

It would also be quite possible, and much better, for the Appeal Board to announce its decision with reasons to follow later. The delay is them writing their decision, not making it. This is done commonly in the Court of Appeal and also avoids uncertainty for everyone.

There’s understandable anxiety about the delay in announcing the EFC appeal outcome, but the timeframes haven’t changed. It takes time, lots of it, to write reasoned conclusions on 3 days of argument by Silks.

In reality the Rules provide for the season to end on the final day, with standings decided at that point in time, when there will likely be unresolved appeals. All in all, it’s about as badly thought out as you could imagine.

If this follows on from the ruling published yesterday, where Leicester successfully argued that it cannot be dealt with under the EFL’s PSR rules until next season, that will prove to have been a spectacular own goal.

EXCL: #lcfc facing charge for allegedly breaching Premier league PSR rules in final season before relegation. Charge could come as early as next week. Leicester won’t face a points deduction this season but could start next season -whichever division they are in- on minus points.
