I’m 3.5 years in. I’m trying a case in October against a lawyer who has been practicing since 1972. My mom was 4 when he was sworn into the bar. Y’all would not believe the shit this guy does.

I just got discovery responses from a plaintiff in a brain injury case that I’m defending. The opening line of plaintiff’s counsel’s email with the discovery responses is “Well this was a chore.” If you don’t want to do the work, then you should probably not be a litigator.

Something I’ve noticed strong leaders all have in common is that they believe blame flows *upstream*, not the other way around. When you’re secure in yourself and your capacity to lead, pointing fingers downward feels beneath you. You just gracefully own it & move forward.

I HAVE BEEN SAYING THIS I got a federal judge to issue monetary sanctions for noncompliance last year. When Defendant finally cooperated, we found them HIDING EVIDENCE. MORE SANCTIONS Do your due diligence in discovery and it will pay off.

Attorneys need to stop taking cases in areas of law they know nothing about or don’t understand. It makes things unnecessarily complicated for clients, opposing counsel, judges, and juries when you don’t know what you’re doing.

@jewels390 When I have was 3rd chair, I was the “firefighter”. Prepare everything. Always have pens, sticky notes, exhibit stickers, etc. Have an iPad or laptop with wifi for quick legal research or access to your Remote Desktop. Bring all necessary chargers. Always bring more than you need

Update: Jury assessed 51% fault on Defendant Attorney and 49% fault on Plaintiff. $10 million verdict, Defendant responsible for $5.1 million. Jury is currently working on punitive damages.
Currently observing a legal malpractice jury trial. Plaintiff is a nursing home who claims its 2023 bankruptcy is due to a verdict from a 2014 negligence trial. Defendant is an attorney who was appointed by the nursing home’s insurance carrier 29 days before trial. 🧵
