The High Court has today afternoon agreed with us and quashed the decision contained in Executive Order No. 3 of 2020 that purported to transfer the Kenya KMC from the Ministry of Agriculture, Livestock, Fisheries and Irrigation to the Ministry of Defense

To the Police officers at Central Police station. Kindly allow Advocates to access and speak to their clients being held in your cells. It's a constitutional right for every citizen to access legal services. Obeying court orders is part of your duty.
We challenged the illegal and unconstitutional removal of our Clients from KU Council by the former administration for standing their ground against the illegal alienation of KU Land. I am glad that the rule of law has had the last laugh.

The Reopening of KMC today and the Public Notice seeking for Public Participation are both acts of Contempt against Court orders that quashed the transfer. The CS and PS Defence should be surely declared unfit to hold Public office for continuously being in contempt of court.
The ELRC has this afternoon issued temporary orders suspending the decision by Prof. Crispus Kiamba from suspending, terminating &/or dismissing our client Prof. Paul K. Wainaina from the Office as the Vice-Chancellor of KU, or from rendering his position vacant.

Every 5 years since the creation of the SCOK, we have had every Presidential elections challenged, a good practice that puts the electoral body on check. Through SCOK we have slowly reformed the IEBC.I am only hoping that 2027 we will have a different Petitioner.
The Labour Court has today agreed with us in its Ruling and declared the Decision by Hussein Marjan Hussein that purported to Interdict our Client, The Deputy CEO of IEBC Ruth Kulundu unlawful.
Yet again, another big win for the rule of law.
The recent arrest of the Commissioner General of Prisons and the decision by Mrima J. directing the DCI Boss George Kinoti to be imprisoned at Kamiti for Contempt of Court should remind all Public officers that power is temporary. Serve with integrity.

The High Court finds that the Supreme Court (Presidential Election Petition Amendment Rules ) 2022 are declared unconstitutional for:
a) Not adhering to Public Participation requirements
b) For usurpation of the authority of Parliament. Great work

In 2022, I brought a petition on behalf of my client Ruth Khatievi Kulundu, the Deputy CEO for IEBC, who was wrongfully interdicted soon after the 2022 General Election.
Today, the Court has exonerated her of any wrongdoing. A win for the rule of law.
The secretariat should not attempt to play games with PC renewals for Members. Let's leave these issues in 2020 for the sake of Peace. Let members be issued with PCs whether they have complied with CPDs or not. 2020 was bad for practice.

If you took time to read the two motions by those Junior Advocates you definitely could have seen merit, but the Seniority syndrome in you will not allow you to partake anything baked by a junior. The society is doomed if some members feel more entitled than others.

He boldly challenged his removal to the apex court. It's an open secret that we have many Chitembwes within the justice system. A bold LSK should issue a certificate of dishonour to him and other judges who have and continue to deliberately undermine the bangalore principle.
Last week, the ELRC Court in Nakuru agreed with us and upheld the decision of the PSC that the termination of the Maasai Mara University VC was wrongful.

It will take sometime for the DCI & NPS to accept their mandate within the criminal justice system. The roles they previously held were donated to the DPP by the Constitution of Kenya 2010 for good reasons. It has taken Courts intervention to ask them to let go 12yrs later.
I was featured in The Legal Magazine’s November 2023 issue wherein i spoke about a variety of issues including the pragmatic approach to the problems facing the legal practice in Kenya and my candidature for LSK General Member.
You are never young to hold any Public office, I predict that the Senate and the National assembly will have youthful men and Women. What I am uncertain about will be their willingness to uphold the rule of law and to independently exercise their oversight role.

The court literally determined the entire petition at an interlocutory stage. Sadly, this has been the case in our constitutional court in the recent past. We will continue the fight regardless.
The President has through executive orders slowly extended the constitutional and Statutory mandate of our Defence Forces. We ought to be very worried.

We have successfully challenged Executive Orders Number 1,2 and 3 of 2020. One having been appealed and pending before the Court of Appeal. The President's advisors should either quit or be relieved of their duties for continuously misleading the President to Kenyans' detriment

It seems the precedent created by the Supreme Court has been adopted by the courts below it. There's a limit when stretching discretion, and this judge here has maxed out that limit. Unfortunate.
We can see the handwriting of IEBC's Lawyers in that statement, the same was unnecessary. The Commission should keep off the issues raised against them. Having in their opinion exercised their mandate as the law envisages, they don't need to justify their conduct at this stage.
The protection of the law practice environment is of benefit to both the Advocates & the entire citizenry. The proposal to have some judiciary services discharged at Huduma Centres needs to be relooked. Access to justice should be qualified. Tunataka haki bora sio bora haki.

The President of the Supreme Court wants to reinvent the Sub judice rule. Limiting the freedom of expression further is unconstitutional. The best remedy is to advice Judges to restrain from reading opinions on matters before them posted on social media or elsewhere.

The HC has suspended Gazette Notice No. 6265 Vol. CXXVI- No. 70 issued by the President on the proclamation of the guidelines on management and terms and conditions of service for board members and staff of state corporations.
In all the police stations we have visited since Tuesday as the LSK and the many advocates who volunteered to offer probono services to members of the public, the Central Police Station tops in violating human rights. It's at Central, where Advocates were denied a chance to see
Earlier today, we attended a mentorship session organised by the Young Lawyers Committee of the LSK in partnership with Kenya School of Law. I wish the students all the best as they prepare for their orals and their ATP exams later in the year.

Court directs the immediate and unconditional release of the 13 individuals held incommunicado. This also includes ANY PERSON who was peacefully protesting, pending hearing on 28th June, 2024.
With the shrinking practice space and the constant increase of practitioners every year, it is incumbent upon the LSK to allow the expansion of practice beyond the conventional traditional practice areas. It's either we innovative or become extinct.

The recent recruitment to the COA has not solved the question of backlog, not at all. I refuse to think that the problem is shortage only. The court largely suffers from slothfulness. JSC should also fix that, their work stretches beyond recruitment.

As members of LSK, we may need to reconsider the procedure followed for admission to the roll of Senior Counsel. Methinks Seniors like Duncan Mindo and Dr. Khaminwa should ideally have already been conferred the title, SC, for their industrious service
