@AVindman We should already have several divisions in Poland. If nothing else, this would discourage Belorussian involvement in the Ukraine war. It would also send string signals to both our Allies and Putin. Joint exercises are a bad idea as well.

@cristianafarias Pointless? Tourgee lost Plessy 7-1, but John Marshall Harlan’s dissent ultimately prevailed in the court of history. So, even if Justice Jackson’s opinion does not garner a majority, it will win in the end, because it is grounded in the truth.

@thehill Maybe she should read the constitution before she talks about what the Founding Fathers did. Article I sec 4 specifically grants power to Congress to oversee state voting laws and Article IV sec 4 requires the fed govt to guarantee a Republican firm of govt, which means voting.

@tribelaw Professor, where in Article II does the Constitution confer such power on the Executive? It is not in the vesting clause and I don’t see it anywhere else. If Biden could make such a declaration, then a Trumper in office could use the same justification for nefarious purposes.

@djrothkopf I don’t agree. The jury did what juries do: listen to the evidence and apply the law to get a verdict. As far as it appears, the jury was drawn from a cross section of the community and held each side to its burden of proof. It is a remarkable system.

He should be tried in open court with witnesses under oath. The standard is reasonable doubt not “beyond a shadow of a doubt. Let’s see what a jury decides.
