This needs to be said. There is nothing 'humanitarian' in granting bail to a young, pregnant woman, jailed by a vengeful state on charges that are seemingly without any basis. Unfortunately, our judiciary has repeatedly ignored the principle that bail, not jail, is the norm.

2019 will be a forgettable year for India’s judiciary. For this year, judiciary failed to protect rights of citizens. Article 370, Kashmir clampdown, CAA & ongoing protests, mass arrests, encounter killings, Ayodhya... the list is unending. I write.

I often see so many retired judges making strong statements about misuse of law, arbitrariness of various statutes (current flavour is sedition), process-being-punishment, etc. Ques is what did they do about these issues when they were on bench. Maybe somebody will do a study.

Unfortunately for this 12-yr-old Tribal girl, her dad isn't a MLA in Bihar. She walked 100 km to get to safety of her home, but died before reaching home, due to exhaustion. Is anybody even bothered/planning about such tragedies that are easily avoidable.

If Fali & Soli who are considered to be conscience keepers of judiciary don't speak up now (CJI can't be bothered much), institution is dead and buried. Or will they suggest we "lump it". Now we know, finally, four SC Judges who held presser were right. Democracy is in peril.

The alacrity with which Centre moves SC against various damning orders of HCs is amazing. If only it had shown even half of this zeal in saving lives instead of event management or perception building, we wouldn't have common people dying for lack of something as basic as oxygen

By AG's logic, "Centre was really concerned with what was going on in CBI. 2 top-most officers were fighting. Media were having a field day. CBI was ridiculed", then CJI Dipak Misra should also have been sent on leave after 4 judges, incl CJI Gogoi, held presser against him.

Either this Rafale judgment is case of govt lying to court or example of mediocrity in the highest court. Either way it is worrisome and deserves action. BTW, if a magistrate had penned such a judgment, it might have cost him his promotion, at least.

Without breaching any confidence, I can say that senior SC Judges have, at least twice in last one month, taken up with CJI Dipak Misra issue of mysterious death of Judge Loya & manner in which he has been assigning imp (read sensitive) cases to junior judges, bypassing them.
