这是芷馨在第一次被带走后录下的自述，12月23日，她被跨省再次抓捕。24天过去，代理律师提交的取保候审请求被驳回，她仍被羁押在北京朝阳看守所，和其他被捕者一样。这些年轻人和她们的家庭无法团聚，甚至不被允许得知她们的任何状况。庆祝的烟火已经响起，因悼念同胞遭到报复的人们却仍处于静默中。

近日据悉，北京亮马河事件中被批准逮捕的参与者涉嫌的罪名由聚众扰乱公共秩序罪变更为寻衅滋事罪。寻衅滋事罪由1979年刑法中的流氓罪演变而来，主要强调无事生非、随意耍横、起哄闹事等行为特征。由于该罪名的法条表述模糊，在司法实践中常被视为万能的“口袋罪”而过度扩张适用。
