Reviewing supporting docs for an H-1B extension I am filing. The employee began his H-1B status in 2008. This is the 10th H-1B petition being filed on his behalf. He started the green card process a decade ago, but can’t be approved for it. Why? Because he was born in India.

Although USCIS did not make any announcement about increasing the maximum validity period for Advance Paroles, we received our first AP renewal that was issued for 5 years. This was not filed concurrently with an EAD renewal and was processed in less than 4 months. #AdvanceParole

In January 2023, the beneficiary of this I-140 petition moved to India to manage the company’s operations there for a year. That allowed the company’s US affiliate to sponsor her as a multinational manager in EB-1. This will shave decades off her wait for a green card.

This has to change. The system was designed to discriminate based on where someone is born. It should never take someone who followed all the rules almost a century to receive a green card. #Immigration

USCIS recently increased max EAD validity to 5 years for certain categories. Our first c9 EAD approval with 5-year validity only took 3 days! Sadly, the AP filed along with it is still pending so no combo card was issued. #USCIS #EAD #Immigration #GreenCard #AdvanceParole

Exactly! @USCIS is wasting resources by requiring separate EAD and AP applications for AOS applicants, especially when there is no filing fee for them. Instead of bringing that filing fee back, make the I-485 receipt proof of employment and travel authorization for one year.

Also, USCIS could be more efficient and use resources more effectively by eliminating EAD and Advance Parole adjudications in many instances. Individuals with pending Adjustments should be able to work and travel upon issuance of the adjustment of status receipts.

In the 5 years prior to the pandemic, the number of EB-2 green cards issued to those born in India averaged just 4,200 per year. People should not have to wait for leftover green cards caused by a pandemic to receive a GC timely

A reminder that the processing time promised by the Department of Labor when the PERM labor certification process was implemented was around 45 to 60 days. PERM was intended to expedite the labor certification process for employers. Time to litigate? @BradBanias @krystal_alanis
