A split Chamber of the @ECHR_CEDH has just found that Switzerland violated Art. 11 ECHR because of COVID-19 measures banning public gatherings, noting the blanket nature and length of the ban. The dissenting judges accuse the majority of abstraction, conjecture and assumptions.

Climate change exists, it's a threat to Convention rights (yes!!), States are aware of it and capable of taking measures to address it, and the risks will be lower if the rise in temperatures is limited to 1.5 degrees.

The Court by 16-1 joined victim status to the merits of the case!! Does this mean it's admissible? by 16-1, they allows the applicant organization's locus standi! Its complaint is for Art. 8 alone, though. The government's objection to this is dismissed.

Human rights are a language for identifying the impacts of climate change. It’s not the only language, it’s not perfect, and we’re still waiting to see how the Court will speak it. But it *can* and *should* be spoken. That much should not be controversial — cynicism isn’t wisdom.

The first ECHR violation judgment relating to the pandemic, and it's an Art. 3 (and 5(1) and 34) case no less! Violation found inter alia because, for 7 weeks, the applicant was needlessly exposed to others in Covid-19 quarantine.
