Honored to give my chair talk, “Democracy, History, and Washington and Lee,” yesterday in recognition of being named as the Robert E.R. Huntley Professor of Law at
@wlulaw
. So grateful for my colleagues, students, and family who were able to attend and help celebrate it!
@VPrasadMDMPH
No,
@VPrasadMDMPH
. “I’m done with COVID” is short for “I don’t care if COVID spreads like wildfire, sickens and kills hundreds of thousands of others, because my own ‘freedom’ is more important to me.” It’s pure selfishness.
NEWS: The state has dismissed its appeal to the 4th Circuit in Seaman v. Virginia, which means the district court's preliminary injunction allowing children with disabilities to request peer masking from their schools under the ADA and Section 504 remains in force. Great news!
Victory! The Youngkin administration has settled our lawsuit and acknowledged that requiring peer and teacher/staff masking is a reasonable modification under the ADA and Section 504 for students with disabilities in Virginia schools.
BREAKING NEWS: Victory! Preliminary injunction granted by the federal court preventing defendants from enforcing EO 2 and SB 739 (the mask-optional law) in schools where the plaintiffs & their children are enrolled!
Children with disabilities matter too. Immunocompromised and vulnerable kids like my son require universal indoor masking in schools to keep them safe.
@elyons822
and I are proud to serve as lead plaintiffs in this suit against
@GovernorVA
’s unlawful Executive Order 2.
BREAKING: On behalf of parents of students with disabilities, we,
@WashLaw4CR
,
@BrownGoldLevy
,
@disAbilityLawVA
&
@arnoldporter
filed a federal lawsuit challenging Gov. Youngkin's Executive Order 2 lifting the mask mandate in Virginia public schools.
Here’s the key passage from the settlement where the state concedes that federal law ensuring that kids have a right to access school safely trumps state law.
Deeply disappointing, but not surprising, decision by
@wlunews
Trustees. Keeping Lee’s name will cause real harm to our students and faculty of color and undermines our efforts to be an inclusive and welcome community. I condemn this moral and practical failure of leadership.
@joanwalsh
Yes! Final tally in (except a small # of late-arriving mail and provisionals that will lean D). Allison Spillman won with over 60% of the vote. Huge victory!
This is flat-out wrong. Sadly, many LGBT kids come from homes where parents aren’t accepting of their sexuality and identity. Mandating that public schools nonconsensually “out” these kids runs the very real risk of abuse and self-harm to them.
To right-leaning TV station,
@GovernorVA
says teachers should out gay, trans kids to their parents:
‘Parents should be informed on all aspects of their children's lives. And it's an obligation of our school system & teachers in order to do that.’
At a minimum, we need systemic reform to the method of selecting
@wlunews
Trustees. Today's 22-6 decision (without disclosing how anyone voted!) was made by a Board and President that is 89% white. The Board has *never* had a woman of color serve as a Trustee.
Delighted to announce that

and I will be publishing our new article, "Beyond Trade Secrecy: Confidentiality Agreements That Act Like Noncompetes," in Vol. 133 of

@k12albemarle
As a parent of two young children in
@k12albemarle
schools—one of whom is especially vulnerable because he is immunocompromised from cancer treatment—thank you for protecting our kids and our community.
“Imagine having to sue your governor to force him to do what a 30-year-old federal law required him to do. This is what Albemarle County residents Dr. Allison Lyons and her husband Chris Seaman faced as they tried to protect their child with disabilities.”
Over 30 states have *mandatory* collective bargaining for teachers & another 10 (now including VA) make it permissive. Suggesting that collective bargaining in
@k12albemarle
is unworkable is simply untenable. It's merely an attempt by some Board members to evade responsibility.
@KrisKobach1787
No evidence any fraudulent votes cast due to Spieles' misconduct. But 100s of legit VA voters turned away from polls due to photo ID in 2014
Grateful for my

Sounds like time to file an open records request to see who advised VDH to adopt this absurd language. So this is my notice to
@VDHgov
to preserve all documents and communications related to the new guidance on COVID.
@GoodForCongress
Almost 275k cases and over 4000 deaths in Virginia from coronavirus.
You need to apologize and retract your wildly irresponsible comment that this is a “phony pandemic.”
I'm still processing the
@wlunews
Trustees' decision, but I have some thoughts about their statement regarding it, which strike me as deeply problematic in numerous ways (thread).
@DrLeanaWen
Why did
@MaggieEThornton
’s entirely legitimate critique result in a block? You may not like her viewpoint, but it clearly isn’t bullying or harassment. (And I should know—as advocates for an immunocompromised child, my spouse and I have received *much* worse from anti-maskers).
Tonight’s vote by the
@k12albemarle
School Board to reject collective bargaining is not in the best interests of our students, teachers, and staff. This misguided decision will result in higher employee turnover and less stability in our kids' schools.
"Lee was a white supremacist, a slave master, and a traitor who betrayed his oath of office. For this reason alone, Lee deserves opprobrium and condemnation, not recognition and honor as one of the University’s namesakes." My letter to
@wlunews
Trustees.
@DrLeanaWen
@MaggieEThornton
You can, of course, block whomever you want, but you can’t call for civil dialogue on one hand and then attempt to shut down legitimate criticism on the other.
Delighted to announce that my article "Intellectual Property and Tabletop Games" with former

student Thuan Tran has been published by the

We are deeply grateful and thankful for all the support we’ve received from doctors, nurses, teachers, family, friends & community members during our family’s journey over the past 4+ years. It truly takes a village to battle pediatric cancer.
In spring of 2021, the Lyons-Seaman family was preparing to face their worst nightmare for a second time. Their eight-year-old son’s leukemia had relapsed after two years in remission.
Please get vaxxed, boosted, and wear the best available mask — not just to protect yourself, but also to protect the immunocompromised like my 8 y/o son, who has been battling leukemia for 3+ years.
@HealthyTJHD
With today's numbers, the health district has reported 807 COVID new cases this month. That means that 12 days into December, this month ranks fourth in terms of new case totals. The record is 1,081 new cases in September.
Hahaha - Disney outsmarted DeSantis. The Rule Against Perpetuities even makes an appearance!
“That declaration is valid until “21 years after the death of the last survivor of the descendants of King Charles III, king of England,” according to the document.”
It looks like Disney just checkmated Ron DeSantis. The board DeSantis appointed to “oversee” Disney is now complaining that the company used a loophole to strip them of their power until 2053.
We need to open the selection process of Trustees to ensure greater socioeconomic, racial/ethnic, and age diversity, and we need to have a real elected Faculty and Student representative on the Board with voting power. This is an educational institution, not a country club.
The lack of diversity among
@wlunews
Trustees -- who are overwhelming white, male, wealthy, and over 50 -- has led to a short-sided decision that keeps those in power comfortable, while refusing to meaningfully tackle white supremacy and racism at our institution.
I'm also going to give a huge credit here to our brave law students who led the charge to change the diploma two years ago, and were the target of horrific abuse for it, even though the Board completely ignores them in its statement.
2. It endangers millions of kids under 12 (who are not eligible to get the vaccine) and the immunocompromised (who might not get robust protection from vaccines).
“Once again the Court is more protective of the rights of wealthy individuals to influence campaigns than of the right to vote.”

This is flat-out wrong. Recommendations by public health officials should be based on science, not polling data or other measures of what they think "people" (however you want to slice that) will accept.
This is an amazing, pro-education agenda by
@JennMcClellanVA
-- state funding to fully implement 2021 Standards of Quality recommendations, more support staff for schools, authorizing local sales tax referenda for school construction, and student data transparency.

Good riddance. Not only was Balow an anti-LGBT bigot who tried to whitewash our kids’ history curriculum, we had to sue her (and won!) so my 9 y/o with cancer — many other kids w/disabilities across VA — could safely attend school during the COVID pandemic.

It's definitely not a win for VA students who are immunocompromised or have other health issues that make them vulnerable to COVID - it effectively closes the schoolhouse door to them. That's why we sued
@GovernorVA
to vindicate students' rights to a safe, in-person education.
There's a stark contrast in the
@k12albemarle
At-Large School Board race. One candidate (Allison Spillman) has all 5 kids in ACPS, while the other (Meg Scalia Bryce) is a right-wing extremist whose kids attend a private, religious school. Read more here:
Anyone who pays thousands of $ in “consulting fees” to a far-right ideologue who spews hatred toward the LGBTQIA+ community and routinely denounces what he calls “government schools” is manifestly unfit to represent White Hall residents on the
@k12albemarle
School Board.
I'll say more later, but 3 things needs to ASAP:
1) The
@wlunews
Board needs to disclose each Trustee's vote. Too important to remain anonymous.
2) The Board must take immediate steps to diversify its membership.
3) Let's do a protest. Today. In front of Lee Chapel.
Great to see
@wlulaw
ranked in top 15 law schools nationally for % of Class of 2022 grads with federal clerkships! Amazing achievement. Many thanks to
@wlulaw_ocs
& the Judicial Clerkship Committee for all their efforts for our students!
First, the Board acknowledges that the decision to retain the name will be "painful" to our students, faculty, and staff of color -- yet decides to do it anyway.
Sounds like Musk is basically just double-dog daring
@FTC
to act at this point. Repeated privacy related violations, now possible anticompetitive conduct by deliberately making Twitter less functional for a possible competitor.
Twitter is limiting functionality for any tweets that link to Substack URLs. This comes just days after Substack rolled out Notes, a product that could compete with Twitter.
Musk appears to be making Twitter worse for users to enact retribution against potential competitors.
I want my son, who is a childhood cancer patient, to “live a full life” too. Allowing a deadly disease to spread in schools via unmasked, unvaccinated students is completely outrageous and jeopardizes him.
Lexi Smith is a 1-issue voter: she wants her kids “live a full life”—to be able to go to school w/o a mask and no vax mandates. “They’ve already lost 2 yrs.” She’s part of effort to recall Fairfax school board members—the group is near the stage and elated. (Smith on the right)
Today’s ludicrous decision on mass transit mask mandate &
@GovernorVA
’s unlawful attempt to violate federal law by prohibiting universal masking to protect disabled kids in school have a common linkage: judge in the former & lead atty in the latter are both former Thomas clerks.
Thank you
@SallyLHudson
for calling for immediate legislative action to codify protections for reproductive rights. Roe is under assault. Don't let Virginia turn into Texas.
@GoodForCongress
You supported an undemocratic attempt to overturn the results of a free and fair election - which both federal and state officials confirmed was not tainted by significant levels of fraud. Shame on you.

I've submitted a draft congressional redistricting plan (

Second, as others have noted, it creates a false equivance betwen the profound harms that are caused by racism and white supremacy, and those who want to acknowledge the "contributions" of the University's namesakes.

School Board voted to reinstate 10 days of COVID leave for teachers & staff — and in response to
@AlbeEduAssoc
President Vernon Liechti’s comments, made it retroactive to July 1! Thank you to everyone who advocated for this important change!
Albemarle County school staff deserve Covid leave. Without it, employees will feel pressured to work while they are sick, putting our entire community at risk. Click the link to read the official statement and help advocate for us!
This is spot-on. Officials in GOP-led states like FL, MO, and WV that are leaving ERIC care more about pandering to the most extreme elements of their party than ensuring voting rolls are accurate. It belies their purported concerns about (nonexistent) widespread voter fraud.
States that leave ERIC will see more dead voters and voters who have moved away on their lists, and reduce their ability to detect double-voting. As a result, they will likely see longer voting lines, more undeliverable mail, and take longer to count ballots. /5
This post says the quiet part out loud. Meg Scalia Bryce and Joann McDermid aren’t running to help improve our public schools for all kids. They’re right-wing culture warriors who seek to advance a narrow, exclusionary vision that will harm vulnerable children.
@DrLeanaWen
And your reasoning is circular to boot. Compliance w/public health intervention is based in part on elite opinion. When folks like you &
@CDCgov
back away from universal indoor masking - despite its effectiveness - of course it's going to have an impact on popular acceptance.
This is a BFD. FTC appears to be proposing a sweeping ban on noncompetes nationally, with an exception only for sale of a business. Full text of proposed rule available here:
@Tbreeden67Tim
@k12albemarle
It’ll fail. SB 1303 requires school districts to follow CDC guidance on COVID mitigation to the maximum extent practicable—which includes universal indoor masking jn schools.
There’s nothing fishy at all about having a billionaire conservative activist “friend” who you met while a Justice that showers you with hundreds of thousands of dollars of luxury vacations, and who also ponied up $500k for your activist spouse’s far-right org. All on the up&up.

“Parents in Virginia know firsthand what it’s like to be targeted by politically motivated actions.” You mean, for example, banning peer masking to prevent a child with cancer from attending school in violation of federal law?
These charges are unprecedented and it’s a sad day for our country, especially in light of what clearly appears to be a two-tiered justice system where some are selectively prosecuted, and others are not. Parents in Virginia know firsthand what it’s like to be targeted by
This is emblematic of how deeply flawed the process (and substance) has been for SB 739, the mask-optional bill. Rushed through both chambers in under a week, with no testimony or input from public health experts and no exceptions for changing conditions.
Va. House Education Committee is limiting public testimony on the bill banning mask mandates in schools to a strict 30 seconds per speaker.
"Because we have session in about an hour" - says
@DelGlennDavis
@UVaKareBear
The school district may not be able to take legal action, but the parents can and should. Any student who spoke & appeared on the video can claim copyright protection as a co-author and then file takedown requests under the DMCA.
Other parents with immunocompromised children *beg* House Education not to put their children’s health at risk. “We have significantly higher risk of death. You would force us to choose between our kids education and our lives.” Others plead to keep virtual learning available.
It’s sickening to see
@GlennYoungkin
surreptitiously withdraw resources from LGBTQIA+ youth after a far-right provocateur inquired about it. He’d rather jeopardize kids health & lives rather than offend his base.

@GlennYoungkin
pulled down some of the most vital resources to LGBTQ+ teenagers in distress continuing his baseless attacks on the LGBTQ community and putting children at risk that he and his supporters say they are “always protecting.”
