about the current and previous threats to democracy discussed in my book, The Presidents and the People.
Remember when AG Barr told us the memos barring indictment of a sitting president were irrelevant to the report? Mr. Mueller just made it clear that was a blatant lie.

I missed the part of civics or Constitutional Law where you seek the presidency by looking to have the Supreme Court overturn a democratic election.
@JohnFugelsang
Please stop the Scalia and Ginsburg were friends nonsense. It’s an attempt to distract from the chasm between them. Yes, they liked each other personally. But she repeatedly made clear his anemic view of the Constitution meant the denial of basic democratic rights.
So, let me get this straight. Our president tells us he might need to intervene in Venezuela because that leader is disrespecting separation of powers?
@JohnFugelsang
Bizarre quote. Manchin conflates a flawed procedure in the Senate with the government, while refusing to investigate the actual attempted destruction of the government.
@JohnFugelsang
Manchin on whether he would gut the filibuster to get Jan. 6 commission bill passed. “I’m not ready to destroy our government. I’m not ready to destroy our government, no.”
CNN raising questions about who is in charge of the executive branch. Pence is giving commands to the National Guard. Impeachment and removal might be required for basic national security and to establish a clear chain of command, not just desirable.
I'm not big on predictions but here goes anyway. Trump v. Vance will be 9 to 0 against the president, clearing the way for the NY DA to get Trump's taxes and criminally investigate the president.
Trump is like a fugitive trying to hide behind the immunity of the presidency. That’s why he is fighting so desperately. What awaits him, should he lose, are criminal investigations in New York State and Manhattan.

When Mr. Mueller said that DOJ policy kept him from charging the president with a crime, so it is time for other “processes,” that means Congress needs to do its job and begin impeachment proceedings.

If your hot take after Trump’s speech yesterday is still that he is a normal Republican President and not a wanna be authoritarian, you are doing it wrong.

If you can, please vote in person, whether early or on Election Day. The sad fact is Trump will likely try to challenge mail in ballots and with this Court he might succeed in upending the election.

Hypothetically, imagine a president who blatantly disregards the oath of office. What should citizens do to stop such a president? What should Congress do? To find out, buy a copy of The Oath and the Office. And OK, you got me, it's not a hypothetical.
I was asked for my comments on Kenedy's legacy. I argue that in the travel ban case—in the twilight of his career—Kennedy tainted his legacy by refusing to live up to the legal principles he established to fight bigotry.

Mr. Trump, when the Constitution says "[a]ll persons born or naturalized in the United States . . . are citizens" that means you can't change it with an executive order, even if you are president. Here, I wrote a whole guide for you:

This convention has been a call for decency. It has been said calmly and without anger. But it is no less urgent. If the call is not heeded I am not sure our institutions can survive another four years.
Given Mr. Cohen's credible testimony just now, it looks likely that the president is guilty of several criminal offenses. Here is my argument for
@washingtonpost
about why a sitting president can be indicted.
Miley said: “He [Pence] was very animated and issued very explicit, very direct, unambiguous orders." But the vice-president has no authority to issue military orders. This is how chaotic our system was that day. The vice-president out of necessity assumed the president's powers!
Why investigate obstruction if the sitting president cannot be inducted? Mueller wanted to keep open the possibility of prosecuting Trump after he leaves office, reporting while the evidence was fresh. He also wanted to provide information for possible impeachment.
Mr. President, a governor cannot repeal a constitutional provision. Here, I wrote a whole explainer for you mapping out this and other principles you need to know. This is very important.

, your duty as a public official, especially in your position, is to be transparent. Asking for a private conversation with one of the nation's leading experts in election law and blocking his public responses to you is a violation of that duty.
The president can recommend governors allow churches to open. Can he require it? No. He has no inherent emergency constitutional powers to do so. And closed churches aren't an emergency, so he can't use The National Emergencies Act. He's unaware of the limits on the presidency.
The first thing a President does in office is take an oath to "preserve, protect and defend" the Constitution. Trump made explicitly clear why he is unable to take that oath and thus unfit to serve. My book about it is here:

asks me the pressing question of whether a sitting president can be charged with a crime. Watch this clip of our conversation about the presidency in the time of Trump.
After the Vance case today some might say "lock him up." I'll put it slightly differently. After the lawful subpoena is served, and the criminal investigation completed, and he is convicted in a court of law, yes, absolutely, lock him up.
John Bolton shows up on January 2 shouting, "Happy New Year!" Sitting on crucial information about the president's high crimes until after the impeachment trial was over is a colossal moral failing. Trump and Bolton should be condemned.
