Nambyar brought Conrad's ideas to court in 1966 during the Golak Nath hearings when the court was once again hearing petitions against land reforms and the amendments that protected them. This time the court explicitly prohibited Parliament from amending the fundamental rights.

When landowners started winning in court, the government went a step further and amended the Constitution. It barred the courts from hearing challenges to land reform laws. In 1951, the court saw nothing wrong Parliament passing such an amendment.

Justice AN Ray had been appointed as the new CJI. The government had superseded 3 senior judges - Shelat, Grover and Hegde - to appoint Ray. They had ruled against the government and said there were limits on Parliament's amending power. Ray had sided with the govt.

After 66 days of arguments, the Kesavananda bench had a month to decide on how they would rule. Usually, in such cases, all the judges sit together to discuss their opinions and decide who will author them. But no such thing happened this time. 🧵 🎧

Through all the court-room action there was plenty of of other frictions and strains. The 13 judges were constantly clashing amongst themselves. The two government counsels had strained relations. The atmosphere was utterly vitiated. And the stakes could not be higher.

The Janata govt which came to power after the '77 elections was determined to undo this amendment. But it failed to undo some provisions: one that that stopped courts from hearing challenges to laws violating fundamental rights and one that gave Parliament total amending power.

In 1976, Parl passed the 42nd amendment during the emergency. Among other things, it banned vaguely defined "anti-national activities," demoted fundamental rights and stripped the courts of their powers. It was seen as a move to institutionalise the emergency.

The SC struck down the amendment SC saying it violated the basic structure. This was the first time that the basic structure was applied by the court. Soon after, in the thick of the emergency, a 13-judge bench suddenly assembled in court one November day.

Hegde submitted his resignation letter to the President moments after he found out on the news. Days later, he was on a train to Bangalore. His son told us that they saw people coming out in support of the superseded judges at every station.

In short, political processes had failed to rectify the worst emergency-era provisions and the basic structure was effectively dead. Nani Palkhivala watched these developments unfold with impatience, he told the press that he was going back to India to fight for human rights.

Thousands of lawyers boycotted work. At one protest, fmr AG CK Daphtary said "There was an essay competition. The student who wrote the best essay got the prize." The “student” was Ray, who got the “prize” of promotion by writing an “essay" or the judgement in favor of the govt.

The government said it was following the recommendations of a 1958 Law Commission report. For 15 years, the government did not act on these suggestions and Chief Justices were appointed by seniority. Now, one day after the Kesavananda verdict, the report was suddenly relevant.

Eventually, De conceded. They had a tea ☕️ party to celebrate the patch up. When Seervai opened arguments on January 9, 1973, he delivered a spell-binding performance, according to those present. The judges just listened in rapt attention.

One day after the #Kesavananda  verdict, CJI Sikri was a relaxed man. He was retiring that day. His immediate jr J Shelat should have been announced as the next CJI but the govt was silent. Sikri was out golfing when, at around 5pm, he was stunned by what he heard on the radio.
