Finally got around to reading the order denying bail to Siddique Kappan. An example of how the default position is that more reasons are needed from orders granting bail rather than those denying it, and how the “prima facie” test of UAPA bail can reduce the process to a mockery.

Almost half of litigation is just an information game. Find out if FIR lodged, if case filed, if warrant issued, if judge sitting, if reply on record etc. If we want to make it fairer for all then ironing out these information asymmetries would be a good place to start.

For anyone who wants to seriously understand how criminal law “works” in India, free advice - stop looking or writing about the supreme court of high courts and go to district courts, preferably outside Delhi. Best way to see that “trickle down” in law is as bad as economy.

You can get lawyers to defend cheque bounce cases, trespass, parking disputes, traffic challans. But art 22 of the constitution denies you a lawyer to contest a preventive detention order sending you to jail for months (if not a year) without trial. Transformative indeed.

Govt cannot bulldoze Article 21 by brute majority. It must send the criminal law bills for public consultation. Especially the Bharatiya Nagarik Suraksha Sanhita which increases preventive police powers, custody during investigation, and restricts bail. Colonial by a new name.

Twenty years ago a different premier investigating agency was starting to come under the scanner for its selective working. That led to a momentous 1997 SC judgment which should have prevented a repeat. Yet, here we are, with politics again taking centre in how the agencies run.

The SC judgment in Vinod Dua’s writ observed that “every journalist will be entitled to protection” wrt prosecutions for sedition and inflammatory speech (124A, 505 IPC). This is great on paper. But there’s recent history to show that SC judgments alone can’t change things (1/5)

There is an op-ed in The Hindu today on the three bills. Some interesting observations: 1. Title suggests it is on 3 bills but content only on one - proposed change to IPC. Thin air on the other two drafts that arguably have a much more serious impact on our lives. (1/3)

In a recent judgment, a bench of the SC said time may come when it has to consider consequences of long incarcerations suffered by persons eventually given ‘clean acquittals’. Wonder if there will be a special category where the SC also stayed release. Just putting it out there.

India’s money laundering jurisprudence is unique the world over - it’s currently constructed almost entirely upon interim orders passed by the Supreme Court, which have stayed judgments of other courts, especially where personal liberty is involved. Phenomenal ingenuity.

Hope people have seen govt’s reported view that BNSS will allow upto 90 days police custody - which is *not* what the law (s 187) says, but is the most draconian position that one can take. Rather than wait for HC / SC to sort house, magistrates must act as first line of defence.

This lust for punitive pre-trial detention is down right sickening. How can the prosecution ever demand and recommend jail for such a person. How can a court not see past “allegations” and look at the “fact” of the accused medically suffering as he is. Shame on us.
