Thread: When is a mother a mother?
Many People have heard of Baby Gammy, the Thai boy born to a surrogate mother and rejected by his Australian commissioning parents due to his having Down’s syndrome whilst they kept his twin sister. Gammy’s mother opted to raise him herself.

It seems that under the new proposals when the baby is born alive the CPs will be the legal parents.
But should the baby be born dead then the Surrogate Mother is the legal parent.
How can this be? Either a woman who gives birth is the mother and legal parent or she is not.
Within “fertility privilege” there is the idea that a woman isn’t using her eggs when she has a period, she’s just throwing them away (as if she is irresponsible). Why doesn’t she ‘use’ her eggs to do some good and help someone else? The “why not help” guilt trip is here already.
Women are universally useful for their labour (work) for their labour (reproductive services) and for their good, cheap deals (poverty and vulnerability).
There is no end to the exploitation made possible by the laws that facilitate this.

In the USA the mother of Seraphina Harrell refused the demands of commissioning parents to abort baby Seraphina due to her serious congenital abnormalities even after being offered $10,000 to do so. The Harrell’s (her surrogate mother & husband) adopted her and cared for her.
The commissioning father proved to be somewhat unreliable, asking her to keep the baby “for a few months” until he had sorted himself.

Obviously the war has exposed the dreadful trade in babies from Ukraine but this isn’t new. Look at the pictures. Many of the babies featured are clearly not newborn. Why have they not been collected. Will they ever have a family?

In another case, unrelated to disability, a UK surrogate mother who had made an unwise independent agreement with friends understood she was ultimately responsible for the baby she was carrying, and appears to have decided to raise the baby herself.
With a pre-birth parental order in place would a surrogate mother need to adopt her own baby, as the Harrell’s did? Who cares for the baby whilst parental responsibility is being decided?

NHSOBG doesn’t seem to realise that the pregnant woman is the patient to which they owe a duty of care. The one person who should be at the centre of all decision making. A woman who will grieve a still born baby. And a woman whose informed consent and privacy are a human right.
Would social services step in leaving the surrogate mother with no say? Would hospitals need to go to court to have the baby declared a ward of court in order for best interests decisions to be made, independent of the (surrogate) mother?
In the consultation document the Law Commission state that if the commissioning parents reject the child then social services will have to step in the same as they would in a situation where natural parents reject a child.
In every single surrogacy arrangement a newborn is removed from his or her mother. Whether she was only paid ‘expenses’ or she was ‘compensated’ for her reproductive service. Every single one. This is

One such event was described by a NHS obstetrician who criticised the SM who arranged the funeral of the stillborn baby whilst excluding the CPs. He seems to have forgotten that the SM was his patient and should have been the focus of his care.
Of course we always say the pregnant woman is the mother and a woman who gives birth must always be the legal parent.
For the Law Commissioners to acknowledge a woman’s grief when the worst happens whilst ignoring it in life seems a particularly perverse and cruel inconsistency.

When the relationship between the Surrogate Mother and the CPs breaks down, all sympathy is reserved for those CPs who had no legal rights over a still born baby delivered by a woman who NHSOBG fails to understand may have been somewhat distressed by the situation
My heart goes out to those women who are pregnant, worried about their families, unsure where they will have the baby or what medical care they can expect. Babies are likely to be born prematurely with their mothers feeling stressed and blood pressure rising. Will buyers collect?

In the final report the Law Commission seemed to take account of the responses and the emotional nature of such an event. They recommended that in the event of a stillbirth the Surrogate Mother would be the legal parent of the baby.

Amazing how these men know exactly what a woman’s body is capable of when they need a child but are completely ‘in the dark’ to the mountain of scientific evidence about our bodies in sport.
A stillbirth is a great tragedy and we acknowledge that CPs will also grieve the loss of “their” baby.
This discussion and the final proposals reveal a desperately sad inconsistency at the heart of the proposals to assign legal parenthood at birth to the Commissioning parents.
