Some observations on access into the legal profession to raise awareness of the issues. We all know that law students are finding it tough to secure traineeships in these times. But how bad is it? The number of traineeship commenced in 2019/20 is down 27% from the previous year.
Niall was one of the good guys. Generous, down to earth, and a mentor to many. The

has lost too many, too soon in the past six months. Paul McNairney, Stephen O’Rourke, Geoff Clarke, and now Niall McCluskey. All gone far too soon. Each sorely missed.
The draft civil court rules published for consultation make virtual hearings the default position in all commercial cases and most other civil business. It is true that we have had virtual courts out of necessity because of the pandemic. 1/6
The legal profession on Scotland shows a strong majority in favour of far greater resumption of in person business than is contemplated in the draft rule. Time to make voices heard before this is foisted on us for all time.

Information Law in Scotland workshop. I might be 16 years older but the Law School looks much the same…other than one important new plaque celebrating a pioneering woman and graduate!
I was involved in an interesting case in the Court of Session this week in which a client sought an order under s. 1 of the Administration of Justice (Scotland) Act 1972 (the so-called “Dawn Raid”) to enter a residence to search and seize various property.
These judges are excellent fact-finders who will do their best. Their quality of decision-making in civil cases is extremely high. But their backgrounds and real-world experiences are going to be very different from most people who go through the criminal justice system. 2/5

Incredibly saddened by this news. I had the privilege of working closely with Stephen over the past few months in a case and then at the Crown Office. One of the most likeable and generous people I have ever met. A huge loss - thoughts and prayers with his loved ones.
This is heartless. An immigration raid detaining individuals on Eid as they come out of the mosque in Pollokshields. There is always a place for compassion and common sense in how the law is enforced.

's tweet made me reflect. In my line of work, why am I usually the only person of colour in a meeting or in Court? How can the justice system be made more diverse? I hope that we are moving towards a more open and honest conversation about these issues.
There are many good reasons to embrace technology but not at the price of a civil court system that values efficiencies over access to justice and the principle of open justice. Just my initial take on the proposals! 6/6

on Twitter as ‘a private members club’. The purpose of making an organisation ‘a private members club’ is to keep people out - yet I can’t think of a single person who met the admission requirements and was denied entry
Can the Scottish court grant UK-wide orders in intellectual property cases? The Inner House in William Grant v Lidl has said "yes" where the defender is domiciled in Scotland (e.g. place of business). It therefore extended the interim interdict from Scotland to the whole UK. 1/3

It is rare for a Court of Session judgment to make me laugh but Lord Braid has achieved this rarity: "I did fleetingly think I had spotted several customers on the video footage but on closer inspection they turned out to be mannequins." (para 21) 🤣
