@ShonenOtaku That's, in large part, a misunderstanding due to lacking localization. In the Japanese script it was always made pretty clear, though briefly, that Sonic being arrested was a cover-story. If you watch the Japanese stage recap for Radical Highway, Shadow outright implies as much.
