Thank you

Ramiz is a proud Palestinian-American.
He is a proud Arkansan.

This is absolutely true. When I was a part-time public defender in Saline Co. Arkansas they decided to crack down on truancy. All it did was drag a bunch of poor people in who were barely making it causing them to miss work and put even more strain on their family. It sucked.
Kamala Harris at an event hosted by the Commonwealth Club in 2010, explaining her decision as San Francisco DA to get tough on truancy.
Critics of truancy crackdowns say such efforts unfairly target poor parents and children without actually helping students.
West Ham is now my team. I didn’t grow up watching soccer but two of my sons love it. I watched my first premier league game with them yesterday and I declared you my team. It was great fun and my sons are attempting to make me more than a “casual” soccer fan 😂
In 2021, we have collected more points (73), recorded more victories (22) and scored more goals (73) in the Premier League than in any previous calendar year.
Moving into the New Year with a lot to be proud of 💪
Marilyn Mosby's Office has filed a motion to vacate Adnan Sayed's conviction.
This motion recounts explosive new information about withheld evidence and previously undisclosed information about alternative suspects.
A 🧵:
Breaking: The Supreme Court, in a 6-3 decision, sides with a former public-school football coach in a dispute over his post-game, mid-field prayer, holding that the First Amendment free exercise and free speech clauses protect him from "government reprisal" for his prayer.
This afternoon I was on a work call. I noticed my middle son was calling in. I got so excited, I am always the one that calls them.
So I rushed to end the call and I click the answer button with a big smile on my face.
“Hello, son!”
“Hi dad, I called you by accident.”
I like how a pre sentence report can take 15 pages to talk about a person's every arrest but buried into a tiny sentence on the almost-last-page is a mention that the client, in the 80s, grew up without running water and electricity.
I just got news that a defendant in a Maryland federal case who had filed for Compassionate Release in the Fall has died in custody without a ruling on his motion.
Like, how could you function as a judge after finding that out?
My son has covid. I just found out. I rarely talk about my kids on here but I feel like pulling on the prayer/dua chain right now.
I’d appreciate you saying one. 🙏
Criminal appellate courts: it is rare that we will disturb the trial court’s discretion as they are in the best position to make findings of fact.
*lower court makes factual finding for criminal defendant*
Criminal appellate courts: well........
I do appreciate the service that

I just wish I could get one of the marketing executives to talk to me about an alternative to drink coupons for those who don’t drink alcohol.
I’ve been asking for 3 years. Please?
All those sorry racists who THOUGHT they paid for the wall are now federal crime victims. I can’t wait for that victim impact statement:
“I thought that money was gonna keep the Mexicans out. I’ve had to have therapy. I can’t even trust racists anymore.”
I grew up in a sundown town: Mena, Arkansas.
I was never taught about the lynching.
I was never taught that the Mena chamber of commerce took out a full page advertisement a few years later saying the town was “100% white.”
CRT isn’t the issue. Real history is.

EVERY Arkansas teacher should take a few minutes next week to tell your students about the Elaine massacre. Tell them about Tulsa. Teach them about Jerome and Rowher. Teach them about Catcher. Teach them about sundown towns.
Speak up. Don't silently assent to this.

As a lawyer who does trials, appeals, and post-convictions, hearing all of this is infuriating.
Withholding evidence should lead to immediate disciplinary action against prosecutors.
I am, on the other hand, grateful that Adnan Sayed received a meaningful review.
If you are Christian, and curious about Jesus in the Quran, this podcast by
@omarsuleiman504
is really fantastic. I literally had zero idea of how revered he was in the Muslim faith.
During trial my apartment looks like I’m an alcoholic police detective down on my luck and my family has left me but I’m about to miraculously solve a case that will then give my life meaning.
I can only hope that over the coming 20 years we will see more and more joint investigations by prosecutors and defense counsel into conviction integrity.
Our courts and police have a tattered record, and we owe it to the people to fix that.

Religious conservatives like them tell us that LGBT are sexually depraved and dangerous.
Growing up in Arkansas and being a lawyer, I know who the common culprits of sex abuse are: uncles, step-dads, and preachers.
Ok, I just read the details of this lawsuit and I’m going to do an entire blog post on it because the actions of people in the Arkansas legislature are so cowardly and vindictive that Google should not forget what they did.

As a criminal defense attorney who does trial, appeal, and post-conviction work, you would be in heaven if you had even one of these issues to work with.
These developments in the Adnan Sayed case are, without hyperbole, breathtaking.
But, there is even more. 👇
I certainly understand the health concerns.
If you are the praying type, please keep those in jail in yours. It is a scary time right now for our clients behind bars.
I filed a FOIA with the Arkansas Department of Health requesting documents related to the Governor's advisory group re: high school sports and COVID-19. I received some preliminary responses to my request just now and I want to share them. I'll add docs as I analyze.

One of these potential suspects
a) had threatened to kill the victim in the case, and
b) provided motives for the threat.
This was an Brady violation because this was evidence not turned over to the defense and it tended to exculpate Adnan Sayed.
No one answers the phone anymore if you aren’t in their contacts. I got a new client and I texted him saying that I’m gonna be his lawyer. He said how do I not know that this is the police trying to trick me.
I was like, me and this guy gonna get along juuuuust fine.
In 2003, only 15 years ago, my grandfather had to order a school not to restrict a boy from talking about being gay. This preliminary letter order contains details of horror of the school staff behavior toward the boy.
Medical mask manufacturers need legal protections to help address our current shortage.
Last week, Democrats killed a vital provision granting those protections, siding with ambulance-chasing lawyers over public health.
That's a disgrace, and we need to fix it now.
After weeks, our clients, a permanent resident mother, and two very young US citizen children are still stuck in Gaza.
It is now life and death.

As a criminal defense attorney who also happens to be Muslim, I’m taking each action I undertake during this pandemic as if I am going to have to explain it all to Allah.
I think about

I think

would be disappointed to hear that my great grandfather, accused of massive theft of coal, gave an interview to the newspaper without his attorney present in 1899.
Hey guys whenever you get Brady material don't you love it that they always say we are sharing this "out of an abundance of caution" ?
It is never like "we are sharing this with you because it is clearly Brady material."
Finally, the prosecutor's office also discloses in this motion to vacate that one of the lead detectives, William Ritz, engaged in misconduct in another murder case that resulted in an exoneration.
The man, in that case, served 17 years for a murder he did not commit.
Well, here it is. Felony for librarians and a class A misdemeanor if you don’t report the librarian. This is

shit.

This is really bad. Several other bad ones out now too.
Moving on from Brady violations, the current prosecutor's office uncovered this year that the location of the victim's care was directly beyond the house of ONE OF THE SUSPECTS.
In that category of new information one of the suspects also:
a) Attacked a woman in her vehicle
b) Engaged in serial rape and sexual assault
c) Engaged in violence against women he knew
d) Was Improperly Cleared

The State's ability to move to vacate a conviction in this way is a recent development. (2019)
The prosecutor can request relief if new information calls into question the integrity of the conviction, and the interests of justice and fairness justify vacating the conviction.
I’m leading jail and prison tours for judges and prosecutors over the next two weeks. It’s very safe.
In fact, you’ll be safer in the jail than you would be at home.

Instead of taking my idea to heart could someone talk to me about taking it to action?

In addition to the Brady violation and new information from the prosecutor's investigation, the State claims it can no longer rely on multiple pieces of evidence presented at the original trial.
The other day I asked a prosecutor for a particular offer.
Response: “My officers would kill me.”
Indictments should read:
Cops of Maryland

For those unfamiliar with the case, Sayed's conviction was the subject of a podcast series,
@serial
.
He was convicted of murdering his ex-gf in 2000.
The current prosecutor's office admits the evidence at his trial was "not overwhelming" and was "largely circumstantial."
Prior to this motion, Adnan had phenomenal legal help. They just couldn't quite get there.
@CJBrownLaw
convinced a circuit judge in Baltimore to vacate Sayed's conviction in 2016 based on the trial lawyer's failure to challenge cell tower location evidence.
This leads us to today.
The Baltimore State's Attorney's Office and

/ Univ of Balt Innocence Project have reviewed all the evidence AND the original prosecutor's trial file.
This investigation uncovered "Brady violations" and "significant reliability issues."
