Understand that Knight Specialty has a problem. This bond cannot be approved. Under the CPLR, the surety will remain obligated under the bond until a replacement bond is filed. Trump is unlikely to get a replacement bond. Knight Spec will be liable AND Trump won't have a stay.
Apparently knowing that they have a problem, they also include the fin statement of Knight Insurance. Not only is it still laughable, but Knight Ins is not a surety on the bond. It doesn't have any obligation to pay if a demand is made.

Here's the deal with the bond. Don't listen to the WSJ. Their article is wrong. An insurance company has to be qualified to write a bond in NY. CPLR article 25 and Insurance Law article 11.
There still is no compelling reason for Justice Engoron to allow this bond to stay collection. It is written by a company not authorized to write bonds in the State, appears to be the only bond it's ever written, and is not adequately capitalized by either the insurer or Trump.
This surety cannot be justified. They're not authorized. They cannot justify the bond without getting State approval. So this is just a huge time waster for Trump. A huge delay tactic. The AG can't do anything until the Court rejects the bond.

I have a correction -- I've said that the collateral is irrelevant. That's wrong. There's a provision of the Insurance Law that allows a surety to write a bond irrespective of its own capital if it obtains collateral for the amount above what it is authorized to write.
If I recall correctly, there was an article reporting statements by the head of Knight that raised questions about whether Trump collateralized the bond and, if so, what that collateral is and whether its value is credible.

A bond has to have a power of attorney and financial statement when filed to be valid. This bond has neither. But they can fix that and refile. This insurance company is not authorized to write surety bonds in NY. If the AG contests the bond, the Court has to reject it.

The amount also can be considered if the insurer has applicable reinsurance (which I doubt Knight Specialty has since it doesn't appear to really be in the surety business).

Not only is the bond "without effect" if they fail to file for justification, but Knight remains liable under the bond nonetheless until a replacement bond is filed.

Here's another issue. The 1st Dept's order says that execution is stayed upon Trump posting a $175 million bond within 10 days. He failed to do so. If I was the AG, I'd take the position that he blew his opportunity to post a $175 million bond. Let him make another motion.
The AG has to object to the bond (known as "excepting"). The bond lacks the required supporting documents and was written by an unauthorized company. Trump then gets 10 days to move to "justify" the surety.

Knight Specialty is not T-listed and they are not approved to write surety in New York. This is a screenshot of a search of "Knight" on the NYS DFS website. I've been doing surety in NY for 30 years. I've never heard of them or seen a bond of theirs.

The Times is reporting that Justice Engoron has scheduled a hearing for the 22nd "to discuss the bond". I don't understand what he's doing. Trump or Knight have to move to justify the bond. They have the burden of proof. There should not be a hearing until they make a motion.

The AG should take the position that the bond is not valid and start executing. She also could move to strike the bond first. I bet this is a delay tactic by Trump. He knows she won't just execute. So she'll move to strike and he'll get more time to find a real bond.
