They're called 'naked ballots'. Tonight, there's concern they could disenfranchise 100,000 Pennsylvania voters. In 2016, the state was decided by 44,000 votes.
Key reminder: Ballot goes into secrecy envelope, both go into outer, declaration envelope.

Commonwealth court orders a Friday hearing on the Mike Kelly/Sean Parnell lawsuit asking to throw away all mail-in ballots.
Also says to pause all activity as it relates to certification.

I’d guess Pittsburgh’s Action News 4 has requested an interview with Congressman Reschenthaler 40ish times since Jan. 6 and he still hasn’t granted us one. We asked today and were told no. Some of Reschenthaler’s constituents feel he’s hiding from our cameras and their questions.
Biden continues to do what he does best – hide.
It’s been over 40 days since Biden took office and he has yet to hold a solo press conference.
Why?
Because he has no explanation for his job-killing policies.
For all the wringing about mail-in ballots postmarked on Tuesday and received up to 5 p.m. Friday:
In Allegheny County, they received 1,045 ballots in the mail Wednesday thru 5 p.m. today.
947 of them were properly postmarked before Tuesday and will be counted.

Here is my Tues. story about Trump Campaign’s lawsuit. You can see video of observers from both parties watching closely as votes were counted. There were also no reports from elections officials of one party being given any sort of preferential treatment.
Nobody wants to report that Pennsylvania and Michigan didn’t allow our Poll Watchers and/or Vote Observers to Watch or Observe. This is responsible for hundreds of thousands of votes that should not be allowed to count. Therefore, I easily win both states. Report the News!
I can't report on what every county is doing, but we know that Allegheny County has not added these late arriving ballots, 947 of them, to their total yet. I also checked in with Armstrong County yesterday. Election administrator said they received "around 40" late ballots.
Yes, this was an error with applications, not ballots. The company which printed them said they made a mistake, not systematic fraud. This impacted 0.3% of the total applications in North Carolina.

Butler-Area representative Mike Kelly, PA-18 candidate Sean Parnell & others suing Pennsylvania to invalidate all mail-in ballots.
They're claiming that Act 77's provisions allowing mail-in voting are unconstitutional and certification of the election should be prohibited.

Josh Hawley criticizing PA legislature for passing state law in 19 that expanded mail in voting, questioning constitutionality. Law was passed by Republican legislative majorities. Rep. Mike Kelly challenged Act 77's constitutionality after the election, but was unsuccessful.

I just spoke with Deborah Jones, who lives in the white house you see in the video. She says she was sitting on her porch and saw the whole thing firsthand.
Jones tells me she did not see the victim with a weapon.

Cumberland County, Pa, where President won by 17.8 points in 2016, decides to start counting mail-in ballots on Nov. 4th, the day after the general election.
No precanvassing means smaller counties need to figure out how to allocate resources, this is how Cumberland is doing so.

I know we're in the weeds of election litigation, but I think it's worth remembering something very basic here in Pennsylvania and around the country:
No court has found that there was any widespread, intentional, malicious fraud in any state.
That's not partisan. It's a fact.
My friend Adam Ward would have been 31 today. Each year on his birthday, I try & play a round of golf, something we did a lot. With the hat of the station we worked at and a shirt dedicated to his Hokies, I like to think today was another round with Adam. May he Rest In Peace.
As to potential impacts:

For example, Allegheny County Elections Board certified yesterday, but was set to meet at 2 today to certify additional ballots that courts ruled on.

Today’s always a tough one. My friend Adam was shot and killed in 2015. Today, he’d have been 33. Sometimes I play a solo round of golf, something we enjoyed doing together. Today it was a 5.10 mile run on 5/10. Adam’s legacy is one of kindness and compassion. I miss him a lot.

Allegheny County Elections Board just voted 2-1 to approve the 2,349 mail-in ballots that the PA Supreme Court ruled yesterday could be counted.

Act 77, Pennsylvania's new election code which expanded mail-in ballots, was passed by Republican majorities in both the House and Senate, and signed by Democratic Governor Tom Wolf.
This suit, filed today, weeks after the election, says Act 77 violates the PA constitution.
I think it's important we remember every time there's a new case, a new hospitalization, a new death, there is a family, friends, people who care and are worried.
It's easy to look at numbers, but we have to remember these are people.

Solicitor also said since the ruling to count these ballots came from PA Supreme Court and the Kelly/Parnell order came from Commonwealth Court, it's another reason these ballots should be certified.

ELECTION-RELATED HEARING DAY IN PENNSYLVANIA
10:00: Allegheny County hearing on whether or not to count about 2,000 ballots received on time, had everything right, except the person signed, but didn't date their ballot.
1:30: Trump campaign lawsuit in PA, federal court.
Wolf said he offered concessions specifically on reducing the number of days after the election that counties could count ballots post-marked on Nov. 3 from 3 to 2, additional security measures for dropboxes, and allowing poll watchers from outside a given county.
The official appeal to the Supreme Court has been filed by Attorney General Josh Shapiro.
Appeal notes that this lawsuit came 2.5 weeks after the election and after "Pennsylvania's presidential election had become clear."
