Under international law, Spain is liable for human rights violations whether they are caused by the executive, legislative or judicial branches. Sanchez is directly liable for the acts of Llarena and the others. Invoking the separation of powers doctrine provides no excuse in law

Last night, I made a formal request to the WGAD to refer the Spanish Government to the Human Rights Council for a motion of censure. Spain has lodged a fake complaint in order to obstruct and discredit a key institution of the UN system of human rights protection.
The Spanish Government’s response to the WGAD ruling is looking increasingly desperate. Now they are complaining about an alleged conflict of interest, and alleging that the decision was leaked to me in advance. There is no truth whatsoever in either of these claims. 1/3

It will all become clear when these bogus complaints are investigated by the UN. This level of deliberate dishonesty from the officials of a UN Member State is rare. Spain is acting like a rogue State. By making these desperate allegations, Sanchez has shot himself in the foot.
Oriel Junqueras, Jordi Sanchez and Jordi Cuixart must be released without delay. Otherwise, it is certain that Spain’s actions will be condemned by the European Court of Human Rights. The Government will ignore the UN at its own peril.

Congratulations to President Carles Puigdemont on a resounding vindication by the UN of his political rights (and the political rights of those who voted for him and were then disenfranchised by the Spanish State). It’s been a long road.
The International Commission of Jurists has issued a strong statement on the trial of Catalan independence leaders - saying the Spanish Government must be held responsible for the police violence, not the politicians who took part in a peaceful referendum.
Translation: “If ESP again disregards the offer of dialogue that we kindly and patiently offer you, then GENCAT is perfectly entitled to lift the DUI suspension without further delay. And the international community would be entitled to recognize the Republic of Catalonia.”

Ad hominem attacks like this are the last refuge of a desperate government. The officials working for Sanchez have deliberately lied to the UN, claiming the decision was leaked to me in advance, when they knew full well that they leaked it themselves to El Pais. They set this up.
It’s easy to support human rights campaigns outside Europe. But Josep Borrell’s human rights record at home in Spain is appalling. Just yesterday, his central political platform was condemned by the UN as discriminatory political persecution.

In Scotland, the courts rule that a firm belief in independence is a protected philosophical conviction, so any unfair treatment of a pro-independence politician is unlawful discrimination. In Spain, the courts just lock up pro-independence politicians.
The Catalan side has consistently repeated its willingness to enter dialogue, and to seek a negotiated solution, before the trial of the political prisoners starts. The silence from Madrid, though, is deafening. If the situation escalates, the world will know who is responsible.
