@Misterbodd Dean, please get real. Hundreds of thousands of teachers do not have another adult in the room. They cannot simply walk off, leave children. Agree - this is down to unnecessary & inhuman (& illegal in respect of human rights) rules from leaders - but this is NOT down to teachers.

This saddens me. At same time as so many call out @Ofstednews grades for tragic loss of a Headteacher, we have schools boasting about their grade. Can we not see the tragic irony? This contributes to the atmosphere which can lead to a tragedy. Please cease boasting about grades.

Wow, heard today of a challenge to LA funding of an EHCP by a Headteacher and……wait for it…… The LA immediately conceded the challenge was legitimate & they awarded well in excess of what the school required! Please - Heads: CHALLENGE!!! My template seems to work wonders.

What a win for a school ive been working with! Headteacher used my approach to require the LA to fund 3 EHCPs correctly in line with Section 42. Today LA conceded, under threat, to give an additional £18,000 per annum for the 3. Onwards and upwards 😊 👍

Yet AGAIN a LA SEND caseworker telling parents they have 15 days to consider the draft #EHCP No. You know CoP 9.77 says parents have AT LEAST 15 days & LA MUST attend meeting during that time to discuss draft if parents wish. Both ‘must’ duties. Both LAW. Stop this utter rubbish.

Ok, let me state this - Confirmed in email directly 2 me 31st March 2022, & enshrined in funding regulations since summer 2015: Schools do not have 2,not required 2,not EVER have 2 pay first £6k of cost of SEP 4 any SEN child in England from their own resources. There we go 😊

Schools/SENDCos: You do NOT know full extent of a child’s needs until & unless an EHCNA is carried out. So, PLEASE stop telling LAs that you dont support the EHCNA request because you think they do not need EHCP. Legal test: whether they MAY need one, NOT whether they DO FGS!!

Let me clarify: If a parent makes a request for a statutory assessment of their child’s needs, pursuant to 36(8) of the Children and Families Act 2014, and the LA demands further evidence AT THIS STAGE from school, that demand is unlawful. It sets a higher threshold than law.

Is it me? If LAs apply what the law says - rather than their own policy around it - then we wouldn’t have anything like so many tribunals, much less case law, and less of a workload for LA #SEND officers. Does that make sense? To me its quite simple. Apply the law.

Please, local authority #SEND team colleagues, stop telling parents they have 15 days 2 respond to a draft #EHCP . NO - they don’t. #SENDRegs : 13(1)(a) clearly says parents/child are allowed AT LEAST 15 days commencing on day the draft was served. Minimum 15 days - not maximum.

I personally know of 2 YP who attend independent school specialising in SEND at cost of £70,000 + each to the LA. If their local schools were appropriately funded and resourced this wouldn’t need to happen.

😊😊😊 Another success to enable schools to deliver EHCP provisions and thereby meet a child’s needs: Informed yesterday that, using my resources and guidance, a trust has secured £80,000 increase in EHCP funding. Please be encouraged by this.

1st for me today. Visited a school on behalf of a SEND parent: *escorted ALL the way from car > reception, to the loo, to signing in & to wait for other people 4 the meeting. *at end, escorted ALL way back to car by 2 members of staff. Do we think my presence worried them?

SENDCos - please stop complaining about workload if you comply with LA policies on a massive list of evidence required for EHC needs assessment. The list is in 9.14 CoP; CAFA 36(8) supersedes, trumps it. Every….time.

Fabulous news today! School I’m supporting in arguing their case 4 full lawful funding by Leeds LA 4 an EHCP was conceded, agreed 2 by the LA after only 3 weeks. We used section 66 duty,Section 42(2) & section 19(1) & (6) 1996 Act. Onwards & upwards! Proves that challenge works!
