Of course it is about personal responsibility but also about a legal duty pursuant to the Equality Act to make reasonable adjustments as regard to everyday activities.

Let me clarify:
“High Expectations” has NOTHING to do with making every child use a reading ruler/overlay when they dont all need it.

Every single SENDCo I have spoken with this week, almost 20, has told me same thing: the NASENCo award failed to prepare SENDCos for the everyday world in terms of SEND law & funding.
It gives them nothing about the practical meaning of the legislation and processes.

The LA immediately conceded the challenge was legitimate & they awarded well in excess of what the school required!

Jo, from perspectives as teacher, parent and specialist consultant, you completely lack the direct experience to comment objectively on this, esp in schools.
Children/YP of all ages frequently mask all day every day due to their needs. Everything ‘bursts out’ when they get home.
I need to remind every LA officer, SENDCo and HT that when requesting an EHC needs assessment, the threshold for agreeing to assessment is VERY low.
It is IN section 36(8) of the CaFA.

This is my last full time year in teaching, after 43 years. I recall clearly my 1st successful interview day. My 1st day as a teacher in school. In 1977. The world was a different place. I still learn something every single day, + still fill up when I see young ppl succeeding.

Headteacher used my approach to require the LA to fund 3 EHCPs correctly in line with Section 42. Today LA conceded, under threat, to give an additional £18,000 per annum for the 3.

This morning: HT used my template to quote several laws & threaten legal if they didnt pay for an item specified in section F.
By 1pm, they conceded in writing & offered to pay
SENDCos: please start following law and not LA policy, practice and procedure.
Yet again, a parent tells me their SENDCo has delayed requesting EHCNA till gets 2 terms of APDR. They often still refuse anyway.
Why oh why? Get the EHCNA in, then start collecting evidence.

Schools do not have 2,not required 2,not EVER have 2 pay first £6k of cost of SEP 4 any SEN child in England from their own resources.

You do NOT know full extent of a child’s needs until & unless an EHCNA is carried out.
So, PLEASE stop telling LAs that you dont support the EHCNA request because you think they do not need EHCP.
Legal test: whether they MAY need one, NOT whether they DO FGS!!
Let me clarify:
If a parent makes a request for a statutory assessment of their child’s needs, pursuant to 36(8) of the Children and Families Act 2014, and the LA demands further evidence AT THIS STAGE from school, that demand is unlawful.
It sets a higher threshold than law.

Disagree. First of all, its arguable as to what “quality” is - what is to one person isnt to another.

I am so TIRED of LAs refusing to assess EHC needs because they say schools have not provide sufficient evidence according to 9.14 of the CoP.
